The panelists for this session will discuss various taxation issues affecting Canadians who are considering emigrating abroad, with a focus on issues involving life insurance policies. Canada is one of the few countries in the world that imposes a departure tax, treating taxpayers emigrating from Canada as if they disposed of their assets and received the deemed proceeds of disposition equal to the fair market value of each asset. They will provide an overview of the departure tax rules, explore what qualifies as a life insurance policy “in Canada” for departure tax purposes, the treatment of individually owned policies, corporate policies, the application of the U.S. excise tax, and tax issues that arise when a non-resident of Canada acquires interest in a Canadian policy, or when a Canadian resident acquires a foreign policy.
For Canadians who move to the U.S., the panelists will also discuss the importance of understanding their new exposure to U.S. estate tax (both federal and state level) and gift tax rules. Certain life insurance proceeds payable to the estate of a U.S. person factor into the policy holder’s gross estate, thus increasing the potential estate tax liability. Implementation of life insurance ownership structures, such as irrevocable life insurance trusts (ILITs), can be great tools in minimizing tax exposure for the estate. Panelists will discuss the various estate and gift tax rules, key considerations of setting up an ILIT, and treatment of corporate-owned insurance in estate tax planning.
