In the mid-2000’s CALU published two CALU Reports which detailed the growth of the life settlements market in the United States, the regulatory environment in Canada which generaly prohibits this type of activity, and the tax and other regulatory rules that apply to life settlements in the United States and Canada. In 2014 CALU formed the Life Settlements Task Force (the “Task Force”) to gather more up to date information on life settlements in the United States and Canada, and assist in the preparation of a comprehensive report for reference by CALU members. This Practice Note, which is reissued and updated from the CALU Report “Update on the Canadian Life Settlements Market” dated April 2015, summarizes the main findings of the research conducted by the Task Force and highlights a number of important considerations for both advisors and their clients.
